(i) The Election Commission is an independent and powerful body which enjoys the same kind of independence that the judiciary does.

(ii) Our Constitution gives it the power to take independent decisions on all aspects of elections from notification of elections to declaration of results.

(iii) The Election Commission has the power to implement the code of conduct and punish any party or candidate that violates it.

(iv) During the period of elections, the Election Commission can order the government to follow certain guidelines including transferring government officials.

(v) Government officials on election duty, function under the control of the Election Commission and not the government.
